What is behind the BVV regulation?
The Contribution Procedure Regulation (BVV) is a key regulation enacted as part of the Seventh Act Amending Book IV of the Social Code. In particular, Section 8 of the BVV stipulates that certain documents relevant to compensation and social security must be available in digital form. These include, among other things, basic data and reports on compensation and periods of employment, work and residence permits, as well as various social security declarations and supporting documents. For certain documents that are required by law to be in writing (e.g., fixed-term employment contracts under Section 14(4) of the TzBfG or termination agreements), a PDF scan is not sufficient. In these cases, a qualified electronic signature (QES) is required by law under Section 126a of the BGB. Through the integration of DocuSign, these documents can be signed entirely electronically, completely eliminating the need for printing, mailing, or scanning.
